Buying a plot in Benahavís

Benahavís is one of the few places near Marbella where there is still land on which to build a made-to-measure villa. The plots for sale sit in established communities: Monte Mayor, in a valley surrounded by woodland; Real de La Quinta, on the hillside above the La Quinta golf valley; El Madroñal, among cork oaks, and El Herrojo; La Zagaleta, inside its private estate; and Los Flamingos and Los Arqueros, beside the golf courses.

The typical plot measures around 3,250 m², often on a slope to make the most of the views. 43 of the 67 plots have sea views. Some come with an architect’s project and a building licence already granted; others are urban land ready for you to commission your own design. What you can build depends on the buildability and site coverage set by the Benahavís planning rules for each community, so the price per square metre of land only tells part of the story.

Before reserving, ask for a land registry extract (nota simple) and a planning report from the Town Hall to confirm that the land is urban and what it allows, and check that the plot has road access and connections to water, electricity and drainage. On sloping land, earthworks and retaining walls can add substantially to building costs. If you buy a building plot from a company, the sale carries 21% VAT plus 1.2% stamp duty (AJD); if the seller is a private individual, you pay transfer tax (ITP) instead.
